Terms of Service

Welcome to Trailmix Maps. Trailmix Maps is an app built and operated by independent individual developers based in Colorado, United States (referred to as “Trailmix Maps”, “we”, “us”, and “our”). These Terms of Service (“Terms”) are a legal agreement between you and us governing your use of the Trailmix Maps app and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

References to the “Trailmix Maps Parties” mean Trailmix Maps together with its developers, owners, operators, contributors, and agents — individually and collectively. Where these Terms limit liability, disclaim warranties, provide a release, or require indemnification, those protections apply to each of the Trailmix Maps Parties personally.

1. Eligibility

You must be at least 13 years old to use Trailmix Maps. Trailmix Maps is not intended for children under 13, and you may not use the Service if you are under 13.

If you are under the age of majority where you live, you may use Trailmix Maps only with the consent of a parent or legal guardian. By allowing a minor to use Trailmix Maps, the parent or guardian agrees to these Terms on the minor’s behalf and is responsible for the minor’s use of the Service.

You may not use Trailmix Maps if we have previously suspended or terminated your account, unless we give you written permission.

2. Your account

You sign in using a magic link sent to your email address. You are responsible for keeping access to your email secure and for all activity that happens under your account. Provide accurate information, do not share your account or impersonate anyone, and let us know at trailmix.info@gmail.com if you believe your account has been used without your permission.

3. Privacy

Our Privacy Policy explains how we collect, use, share, retain, and delete information. By using Trailmix Maps, you acknowledge that we handle information as described in the Privacy Policy.

4. Your content

You keep ownership of the content you create or upload to Trailmix Maps, including your outings, notes, trip reports, photos, comments, cheers, and profile information (“Your Content”).

By posting or uploading Your Content, you grant Trailmix Maps a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, perform, transmit, modify for technical purposes, and distribute Your Content as needed to operate, provide, secure, moderate, and improve the Service. This includes showing Your Content to the people you have chosen to share it with, creating thumbnails or previews, storing backups, and processing Your Content through our service providers.

This license ends when you delete Your Content or your account, except that we may retain copies for a limited time in backups, logs, moderation records, legal/safety records, or where Your Content has already been shared, copied, screenshotted, or otherwise retained by other users.

Your Content may be visible to others depending on your privacy settings and how you use the Service. Other users may save, copy, screenshot, or share content that is visible to them. Do not post content you do not want others to see or associate with you.

You are responsible for Your Content and confirm that you have all rights needed to post it. Do not post content that infringes someone else’s rights, violates someone’s privacy, or violates these Terms.

5. Acceptable use and zero tolerance for objectionable content

Trailmix Maps is a community. To keep it safe, there is zero tolerance for objectionable content or abusive behavior. You agree that you will not post content or engage in conduct that:

We may remove content and suspend or terminate accounts that violate these Terms, at our discretion.

6. Reporting, moderation, and enforcement

You can report or block another user from their profile. Reporting a user flags their account for our review; blocking a user removes their activity from your feed and prevents interaction where supported by the app. We may review reports, remove content, restrict visibility, suspend or terminate accounts, or take other action when we believe content or behavior violates these Terms or applicable law.

We aim to respond to reports promptly, especially reports involving safety, harassment, abuse, or illegal content, but we do not guarantee that we will review every report within a specific time period. Blocking a user removes their activity from your feed and prevents interaction where supported by the app. These tools help us keep the community safer, but they are not a guarantee that you will never encounter content you dislike.

We may use automated tools, manual review, user reports, keyword filters, or other methods to detect or limit objectionable, abusive, spammy, or unsafe content.

7. Outdoor safety and reliance

Please read this section carefully. Trailmix Maps is a tool for logging and sharing outdoor accomplishments and may include maps, locations, lists, and community content. Trailmix Maps is not a safety, emergency, route-planning, or backcountry navigation tool, and it is not a substitute for proper planning, official maps, current conditions, training, guides, permits, land manager information, or your own judgment. In an emergency, call 911 or the appropriate local emergency service.

You use the Service and undertake any outdoor activity at your own risk.

We do not verify the identity, experience level, qualifications, safety practices, or claims of users. You are responsible for deciding whether and how to interact with other users, meet up with others, or rely on user-generated content.

Assumption of risk and release. You knowingly and voluntarily assume all risks associated with your use of the Service and with any outdoor activity you undertake, whether or not it is logged in Trailmix Maps. To the maximum extent permitted by law, and except for claims that cannot legally be waived, you release, waive, and agree not to sue the Trailmix Maps Parties for any injury, death, loss, or damage of any kind arising out of or related to your outdoor activities, the conditions you encounter, or your reliance on any information in the Service.

8. Trailmix Maps content and intellectual property

Trailmix Maps and our licensors own the Service, including the app, software, design, visual elements, branding, text, compilations, and other materials we create or provide, except for Your Content and third-party content.

Some information in Trailmix Maps, such as peak names, park names, locations, elevations, list entries, and other outdoor facts, may come from public, third-party, community, or official sources. We do not claim ownership over facts, public-domain information, or third-party materials. Third-party names, logos, trademarks, and official list names belong to their respective owners. Unless we clearly say otherwise, Trailmix Maps is not affiliated with or endorsed by any park agency, outdoor organization, list maintainer, trail organization, or land manager.

We grant you a limited, personal, non-transferable, non-exclusive license to use the Service for personal, non-commercial purposes. You may not copy, scrape, redistribute, sell, reverse engineer, or create derivative works from the Service or our content except as the app allows or as permitted by law.

9. Feedback

If you send us ideas, suggestions, bug reports, feature requests, or other feedback, you agree that we may use them without restriction or compensation to you. You are not required to provide feedback, but if you do, we may use it to improve Trailmix Maps.

10. Copyright complaints

If you believe content on Trailmix Maps infringes your copyright, please contact us at trailmix.info@gmail.com with enough information for us to identify the content and respond to your concern. We may remove or disable access to content that we believe may infringe another person’s rights, and we may suspend or terminate accounts of users who repeatedly infringe or are repeatedly accused of infringing copyrights.

If we designate a formal copyright agent, we will make that contact information available in the app or on our website.

11. Third-party services

The Service uses third-party services, including Mapbox for maps and Supabase for backend infrastructure, and may contain links to or resources from third parties. Your use of features powered by these services may also be subject to their terms. We are not responsible for third-party services or content.

12. Service changes

Trailmix Maps is an early-stage product and may change over time. We may add, remove, suspend, modify, or discontinue features or the Service at any time. We are not responsible for any loss of access to features, content, data, or functionality, except to the extent required by law.

13. Fees and payments

Trailmix Maps is currently free unless we clearly state otherwise. If we offer paid features, subscriptions, or in-app purchases in the future, additional payment terms may apply and will be disclosed before purchase.

14. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Trailmix Maps Parties do not warrant that the Service will be uninterrupted, error-free, or accurate.

15. Limitation of liability

Except where liability cannot be limited or excluded under applicable law, and to the maximum extent permitted by law, the Trailmix Maps Parties will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Service or any outdoor activity. To the maximum extent permitted by law, the total aggregate liability of the Trailmix Maps Parties for any and all claims relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars ($100).

16. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold the Trailmix Maps Parties harmless from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from Your Content, your use of the Service, your outdoor activities, or your violation of these Terms or of any law or the rights of another.

17. Termination

You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate your access if you violate these Terms or to protect the Service or its users. Sections that by their nature should survive termination — including content license grants already exercised, disclaimers, limitations of liability, and indemnification — will survive.

18. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect means you accept the updated Terms.

19. Governing law

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws principles. You agree that the state and federal courts located in Colorado have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to venue in those courts, except where applicable law requires otherwise. Before filing any claim, you agree to first contact us at trailmix.info@gmail.com and try in good faith to resolve the dispute informally.

20. Apple App Store

If you download Trailmix Maps from the Apple App Store, you acknowledge that these Terms are between you and Trailmix Maps only, not Apple, and that Apple is not responsible for the Service or its content. Your license to use the Trailmix Maps app is a non-transferable license to use it on Apple-branded products you own or control, and is also subject to the Apple Media Services Terms and Conditions and Apple’s standard Licensed Application End User License Agreement. Trailmix Maps, not Apple, is solely responsible for the Service, for providing any maintenance and support, and for addressing any claims relating to it (including product liability, legal or regulatory compliance, and intellectual property claims). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
